Procedure to exchange an item:
Introduction
This document specifies the Policies, Terms and Conditions of MackTak Mart Corp regarding Sales and Customer Service. Sales cover transactions involved in the process starting from receiving the order from a customer to delivering the merchandise to the customer. Customer Service covers activities of handling the sales with customers as well as after sales activities including managing Exchanges, Store Credits etc. Sales and Customer Service can be communicated on-line, over-the-phone and in-store.
In this document, as to the subject matter contained herein,
- the words “we”, “us”, “our” “MackTak”, “MackTak Mart”, “macktakmart.com” refer to MackTak Mart Corp.;
- the words “you”, “your”, “yours”, “customer” “online customer” refer to a person and/or entity with whom a customer relation is established through Sales and Customers Service, and who, in good faith, intends to purchase merchandise from us;
- the words “goods”, “merchandise”, “items” refer to the products which are advertised on-line and/or in-store to sell to the customers.
We reserve the right to change, amend and/or cancel the whole and/or any part of this document without prior notice to customers. Changes, Amendments and/or Cancelations will be announced on our home page and on other key pages on our site.
If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Changes posted on our web site goes into effect on the same business day. Copyright and other relevant intellectual property rights exist on all text relating to the Company’s services and the full content of this website.
Sales Terms and Conditions
Orders
1. By submitting orders on-line, in-store and/or over-the-phone you accept and agree to our Policies, Terms and Conditions.
2. All advertised items, prices and promotions are subject to availability of stock.
3. Due to the nature of the merchandise advertised on our website, No Cancelations, No Returns are accepted and No Refunds issued on confirmed orders.
4. We reserve the right not to provide goods or services, terminate membership accounts, remove or edit content, or cancel orders (as a whole or part thereof) at our sole discretion. MackTak Mart will not be held liable for loss and/or damages due to the cancellation of order by us.
5. For Exchanges and Store Credits please refer to Exchanges.
6. Absolutely No Returns, No Refunds, No Exchanges on items marked for Sale. Sale items are Final sale, and no free shipping offered on them.
7. Absolutely No Returns, No Refunds, No Exchanges on Special Orders. Special Orders are orders on items which are made/cut according to your specific requests for measurement, size, pattern, and accessory. Special orders must be fully prepaid.
8. All in store purchases are final sale. In store and online prices and stock availability may differ. Availability and prices of on-line and in-store items may vary. No Free shipping for in store purchase.
9. You must provide all essential information regarding your identity (personal information including your full name, contact, size), address (billing and shipping), payment (Debit/Credit Card information), and important dates (wear date) to process your order. We will not be responsible for delays resulted from Orders with incomplete information. All personal information may be used to create your online profile, which you agree to utilize on “Fair Usage” terms for purchasing items from our website.
10. All information provided by you will be held private and confidential, not to be disclosed to third party unless otherwise required by law.
Payment and Credit Verification
1. All Orders are charged to your Debit/Credit Card upon shipment.
2. Your information will be protected by an SSL Connection (Secure Socket Layer) when transmitted to the bank to process the payment.
3. We reserve the right to refuse or cancel any transaction, membership account, and/or orders, upon suspicion of fraud. The site is only available to customers, who fit our terms of eligibility.
4. Personal information will be requested and needed upon purchase such as a valid name, phone number, e-mail address, billing and shipping addresses or a valid ID. You are also required to provide proper and valid payment details that match the requested billing address.
5. Upon purchase you are authorizing us to perform proper credit checks, and when we feel necessary, to transmit, identify or authenticate that the information provided is valid. Macktak may conduct other means of verifying information provided, which are not listed in this Terms but permissible by law.
Price Match Policy
1. To price match, Style, Color and the size of the item, must be the same, and must be available for immediate purchase from the source and Macktakmart.com.
2. The seller must be authorized by the manufacturer as an official retailer of the brand.
3. Only one Price Match per item is allowed.
4. Price Match applies to the purchases for personal use only.
5. Customer must apply for price match before placing the order.
6. We reserve the right to deny claims, if we feel that our policy is being abused.
Shipping and Freight
MackTak Mart delivers globally. Delivery dates vary depending on the availability of the ordered item as well as your address.
1. All items will be shipped promptly within 3 to 14 business days or upon personally requested terms of shipping, which can be specified in the field "Wear Date" when the order is placed.
2. All items will be required to be signed for upon arrival, to ensure the safety of the delivered item.
3. Information pertaining all shipping information or status will be confirmed by the shipping department via email or by logging to your account. You may also contact by means as advertised on the website.
4. MackTak Mart offers free international shipping on orders over $250.00. Only the items are marked as “Free Shipping” on the website will be shipped free for on-line and/or over-the-phone orders. No Free shipping for in-store orders and/or purchases.
5. The items of Terani Couture collections are NOT covered under “Free Shipping” policy. We will “price match” on international shipping charge for Terani Couture collections only, i.e. if you find the same item is shipped free from the confirmed source we will ship it free.
6. Upon dispatch of an order, you will be immediately provided with a tracking number via email, which will allow you to track your package. Additionally you can track your package by logging into your personal account.
7. Customers are responsible to provide correct and valid delivery address. We will not be responsible and/or liable for any expenses deriving from incorrect shipping address. Additional charges may apply for address corrections, at MackTak discretion.
8. Customers must inform MackTak Mart in case of non-delivery by the carrier within 24 hours of original delivery date scheduled by the carrier. Only then will MackTak Mart lodge enquiries with the shipping company to ensure and redirect the shipment.
9. MackTak Mart is not liable for any loss and/or damages resulted in transit and/or during transportation. Items which are lost in transit will be replaced solely at our discretion, and only if the lost item may be replaced before wear date.
10. Late deliveries by carrier do not constitute as a failure to deliver and does not entitle you to cancel your order.
11. International deliveries may be delayed due to customs regulations of the destination country, for which we will not be liable for losses and/or damages and we will not accept cancellations.
Taxes and Duties
Customers are responsible to pay for taxes, duties and/or other government collections which are in effect in their locality, place of residence and/or a country of residence, imposed by respective governments and/or government agents.
Exchanges, Store Credit and Faulty Goods
Due to the nature of the merchandise advertised on our website, No Cancellations, No Returns are accepted and No Refunds issued on confirmed orders.
However, as of January 1, 2012 we offer Exchange or Store Credit on selective items from certain collections and which will be marked as "Exchangeable for full store credit. No restocking fee or hidden charges (Part of our MackTak Culture)" on the website.
Exchange and Store Credit policy does NOT cover the shipping charges of sending item for exchange back to us, nor do we allow shipping cost deductions.
Exchange policy is subject to the availability of stock. In case we cannot offer a substitute item for exchange, we give a store credit. Please refer to Store Credits for more information.
No exchanges will be allowed without written Exchange Authorization Number (EA#) from our office. All boxes will be refused without a valid Exchange Authorization Number (EA#) by our shipping department. We will not be liable for the cost of shipping which is refused for this reason.
Free accessories and shoes are NOT eligible for Exchange. There will not be free accessories with exchanged item if the original accessories are not returned back to us.
Already exchanged items are NOT exchangeable.
Eligibility for an Exchange
1. Item must be of one of the selected collections: Sue Wong, Tadashi, Terani Couture;
2. Item must be marked "Exchangeable for full store credit. No restocking fee or hidden charges (Part of our MackTak Culture)" at the time of purchase on the website.
3. Customer must contact us within 48 hours from receipt of the item for an exchange.
Procedure to exchange an item:
1. Request an EA# (Exchange Authorization Number) from MackTak Mart by calling our customer service at 212.302.2468 within 48 hours of receipt of the merchandise. Please do not email us without a prior call. Emails that were not previously confirmed over the phone will be ignored.
2. Check availability of the item you want to exchange for and place a new order online or over the phone.
3. Ship back the item which is approved for exchange. EA# (Exchange Authorization Number) must be printed clearly outside of the box. Otherwise the box will be rejected.
4. The reordered item will be shipped out within the discussed time frame.
Faulty Goods
We inspect all items before shipping for factory defects to ensure the quality. Nonetheless, if you receive faulty goods, you must contact our customer within 24 hours from the receipt of the merchandise.
Customer must request and submit Exchange Authorization Form to MackTak Mart. MackTak may require you to send an image or photo of faulty item and/or the defect.
Faulty items will be Exchanged or given a Store Credit only. No Refunds for faulty goods. No exchanges will be allowed without written Exchange Authorization Number (EA#) from our office. All boxes will be refused without a valid Exchange Authorization Number (EA#) by our shipping department. We will not liable for the cost of shipping which is refused for this reason.
Issuing Exchange Authorization Number does NOT constitute an actual Exchange or Store Credit until the item is received back and approved after inspection. If the inspection indicates the item was tampered with, MackTak reserves the right to refuse the Exchange and/or Store Credit and send the item back to the customer.
If we cannot replace or exchange the faulty item, we will give a Store Credit. Please refer to Store Credits for more information.
Store Credits
The Store Credit is issued only in cases when we cannot replace an Exchange item and/or Faulty Goods.
Our Store Credit is valid up to 3 (three) years from date when Exchange and/or Faulty Good is approved.
Store Credit can be used on all items on the website and/or in store subject to availability of stock.
No Store Credit is allowed on shipping and/or freight charges, free accessories and/or free promotional items.
Promotions
All free items are Promotional items, and subject to availability of stock.
If we do not have the item you picked, we will do our best to inform you and give you an option to pick another style/color/size.
Sometimes, though, to keep up with the pace of orders that we receive, if we do not reach you right away and the wearing date is close, we would ship you the items matching with the dress you bought at our discretion.
No Refund, No Store Credit and/or No Cash Value are offered for the Promotional items.
Free accessories and free shoes are included only in the packages that are shipped directly from our warehouse.
Delivery of Ordered items and Promotional items may vary.
Fair Usage
Means:
- You would like to purchase an item of your choice from the website in good faith.
- You do not intend to defraud, harass, abuse or insult others by any means.
